These Terms of Use ("Terms") govern your use of the Calory application ("Calory", "the app", "we", "us"). By downloading or using Calory, you agree to these Terms. If you do not agree, please do not use the app. You must be at least 16 years of age (or the age of digital consent in your jurisdiction, if higher) to use Calory.
Calory is not a medical device and does not provide medical advice. The app estimates nutrition and offers general information and suggestions about food. It is not a substitute for professional medical advice, diagnosis, or treatment.
Always seek the advice of your physician, a registered dietitian, or another qualified health provider with any questions about your health, diet, a medical condition, medication, allergies, pregnancy, or before starting any diet or nutrition program. Never disregard or delay professional medical advice because of something you read or received in Calory.
Calorie and nutrient targets shown in the app are general estimates and may not be appropriate for you. Reliance on any information provided by Calory is solely at your own risk.
Calory is designed to support general healthy eating and is not intended for the treatment or management of any eating disorder or medical condition. If you are experiencing disordered eating, or if tracking food, calories or weight negatively affects your wellbeing, please stop using the app and speak with a doctor or a qualified professional. The AI features are instructed not to provide restrictive dieting guidance in such situations, but they are not a source of clinical support.
Calory uses artificial-intelligence technologies to recognize foods, estimate calories and nutrients, and generate coaching answers and recipes. This output is an estimate and may be incomplete, inaccurate, or unsuitable for your circumstances. We do not warrant the accuracy, completeness, or reliability of any AI-generated result. You are responsible for reviewing and, where necessary, correcting the results before relying on them, and for verifying ingredients and nutrition where accuracy matters (for example, due to allergies).
Calory offers an auto-renewable subscription, "Calory Pro", which unlocks additional features. The following applies to subscriptions purchased through the App Store:
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Calory on Apple devices that you own or control, for your own personal, non-commercial use, subject to these Terms and the App Store terms.
You agree not to misuse the app or the service. In particular, you agree not to:
We retain all intellectual property rights in the Application, including its code, design, trademarks, service marks, trade names, logos, and branding. These Terms do not grant you any rights in them except the limited license described above.
To the fullest extent permitted by law, the app is provided "as is" and "as available" without warranties of any kind. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on nutrition estimates, AI output, or other information provided by the app. Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of your misuse of the app or your violation of these Terms.
We may suspend or terminate your access to the app if you breach these Terms. You may stop using the app at any time and delete your data using the in-app reset option.
These Terms are governed by the laws of the jurisdiction in which the Service Provider is established, without regard to its conflict-of-law rules. Mandatory consumer-protection rights available to you in your country of residence are not affected.
Where the EU Digital Services Act applies, you may contact us at the address below regarding content or service concerns. We will handle notices and complaints in good faith and in accordance with applicable law.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy and the applicable App Store terms, constitute the entire agreement between you and us regarding the app.
We may update these Terms from time to time. Material changes will be reflected by updating the date at the top of this page and, where appropriate, notified in the app. Continued use of the app after changes take effect means you accept the updated Terms.
